The United States limits the number of new H-1B visas to 85,000 per year. An overseas skilled worker seeking an H-1B visa must have a job offer and company sponsorship. The company must prove to the U.S. Citizenship and Immigration Services agency that the job is a “specialty occupation” and the skilled worker will be a bona fide employee of the company sponsoring the visa.
The USCIS reportedly received more than 236,000 applications between April 1 and April 7, 2016, for an Oct. 1, 2016 start date that coincided with the government’s 2017 fiscal year. The entire 85,000 H-1B visas were allocated within a week.
It’s not an easy process and is likely to change. President Trump has already signed a series of executive orders related to immigration and changes to the H-1B visa program are expected soon. Congressional leaders are also preparing to introduce new bills concerning skilled worker visas.
